RightToNotify — Federal Inmate Transfer Notification Service

Please read these Terms of Service carefully before using RightToNotify. By subscribing or otherwise using the service, you agree to be bound by these terms. If you do not agree, please do not use the service.
1. About RightToNotify
RightToNotify is a notification service that monitors the Bureau of Prisons (BOP) public inmate locator on behalf of subscribers and sends SMS alerts when a federal inmate's facility changes. We operate independently of the BOP and the federal government. We are not a legal service, a prison advocacy organization, or a substitute for official communications from the BOP or any correctional institution.
2. Eligibility
You must be at least 18 years old to use RightToNotify. By subscribing, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms.
The service is intended for use in the United States. We make no representation that it is appropriate or available for use outside the U.S.
3. The Service
RightToNotify queries the BOP's official public inmate locator (bop.gov) once daily, typically at approximately 2:00 AM UTC. When we detect a change in the facility associated with a register number you are monitoring, we send an SMS notification to your verified phone number.
We make no guarantee as to:
- The exact time of day a notification will be delivered after a transfer is detected.
- Whether the BOP's public inmate locator reflects a transfer in real time or with delay. We can only report what the BOP system makes available.
- Uninterrupted or error-free operation of the service.
RightToNotify is a supplementary tool. It does not replace your own diligence or official communications from correctional facilities or the BOP. Time-sensitive decisions — including travel to a facility — should always be confirmed directly with the BOP or the facility before acting.
4. Account and Phone Verification
To receive notifications, you must verify your phone number via a one-time passcode (OTP) sent by SMS. By completing verification, you confirm that:
- You are the authorized user of the phone number you provided.
- You consent to receive automated SMS messages from RightToNotify at that number.
You are responsible for keeping your phone number current. If your number changes, you must cancel your existing subscription and re-subscribe with your new number. We are not liable for notifications sent to a number you no longer control.
One subscription per phone number per inmate register number is permitted.
5. Acceptable Use
You agree to use RightToNotify only for lawful purposes and in a manner consistent with these Terms. You agree not to:
- Use the service to harass, stalk, surveil, or harm any person, including the inmate whose register number you are monitoring.
- Attempt to gain unauthorized access to our systems, infrastructure, or data.
- Use automated means to submit subscriptions or interact with the service in a way that places undue burden on our systems.
- Impersonate another person or provide false information when subscribing.
- Use the service in any way that violates applicable local, state, federal, or international law.
We reserve the right to suspend or terminate access for any subscriber we reasonably believe is violating these Terms.
6. SMS Messaging
By subscribing, you consent to receive automated SMS messages from RightToNotify. These messages will be sent to the phone number you verified during signup.
Message frequency varies based on inmate transfer activity. Most subscribers receive few or no messages in a given month. Standard message and data rates may apply depending on your mobile carrier and plan. RightToNotify is not responsible for any charges your carrier imposes.
To opt out at any time, reply STOP to any message from us. After opting out, you will receive one final confirmation SMS and no further messages. To re-subscribe, you must complete the signup and verification process again.

7. Data and Privacy
Our collection and use of your personal information is governed by our Privacy Policy, available at righttonotify.com/privacy. The Privacy Policy is incorporated into these Terms by reference. By using the service, you also agree to the Privacy Policy.
8. Accuracy of Information
All inmate location data displayed or transmitted by RightToNotify is sourced directly from the BOP's public inmate locator. We do not modify, interpret, or supplement that data. We are not responsible for inaccuracies, delays, or omissions in the BOP's data.
A notification from RightToNotify reflects what the BOP system reported at the time of our query. It is not a guarantee that the inmate is currently located at the facility named in the alert.
9. No Legal or Professional Advice
RightToNotify provides location change notifications only. Nothing in the service or these Terms constitutes legal advice, correctional guidance, or any other professional advice. If you need legal assistance related to an incarcerated person, please consult a licensed attorney.
10. Intellectual Property
All content, design, software, and materials associated with RightToNotify are owned by or licensed to us and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the service without our prior written consent.
Nothing in these Terms grants you any ownership interest in the service or its underlying technology.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
- NOTIFICATIONS WILL BE DELIVERED WITHIN ANY SPECIFIC TIMEFRAME.
- THE BOP DATA WE RELAY WILL BE ACCURATE OR COMPLETE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN THOSE JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RIGHTTONOTIFY AND ITS OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:
- TRAVEL COSTS INCURRED IN RELIANCE ON A NOTIFICATION.
- COSTS ARISING FROM A MISSED OR DELAYED NOTIFICATION.
- ANY HARM ARISING FROM INACCURATE DATA IN THE BOP'S SYSTEM.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED $100 USD, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
13. Indemnification
You agree to indemnify and hold harmless RightToNotify and its operators, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the service, your violation of these Terms, or your violation of any rights of a third party.
14. Termination
You may cancel your subscription at any time by replying STOP to any message or by contacting us at the address in Section 15. Cancellation stops future notifications. It does not delete data already collected; see our Privacy Policy for data retention details.
We reserve the right to suspend or terminate your access to the service at any time, with or without notice, if we believe you have violated these Terms or for any other legitimate operational reason. We will not be liable to you for any termination of access.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top. If we make material changes, we will attempt to notify current subscribers by SMS. Your continued use of the service after updated Terms are posted constitutes your acceptance of the changes.
If you do not agree to updated Terms, you should cancel your subscription before the changes take effect.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law principles.
Any dispute arising from or relating to these Terms or the service shall first be addressed by contacting us directly to seek an informal resolution. If informal resolution is not possible within 30 days, disputes shall be resolved by binding arbitration in Wyoming in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent immediate harm.
You agree that any claims will be brought in your individual capacity only, and not as a plaintiff or class member in any purported class or representative proceeding.
